Terms of Use
Last updated September 23, 2026
Draft pending counsel review. Highlighted items are open questions for review and will be removed before publication.
These terms govern your use of the Diamond Deck website (the "Site"), operated by [COUNSEL: legal name] ("we", "us"). By using the Site you agree to them. If you use the Site for a company, you confirm you may bind it.
What the Site Is For
The Site gives product information about the Diamond Deck scaffold toeboard bracket and lets you request a quote. Nothing on the Site is an offer to sell. A sale or rental happens only under a written quote or agreement signed or accepted by us, and its terms control over anything on the Site.
Savings Calculator and Estimates
The savings calculator produces estimates from the numbers you enter and from assumptions shown next to the result. The assumptions are planning figures, not measured results from your site. Estimates are not a promise, guarantee or warranty of time saved, cost saved or any other result.
Prices and Availability
Any price shown on the Site is indicative only. Price, freight, taxes, rental terms, lead time and availability are confirmed only in a written quote. We may change or withdraw products and prices at any time.
Safety and Compliance Remain With the Employer
Diamond Deck is one component of a toeboard system. OSHA does not approve, certify or endorse products. The employer and its competent person remain responsible for scaffold design, erection, inspection and use, and for compliance with 29 CFR Part 1926 Subpart L, site rules and any owner specification, including the rule on intermixing components from different manufacturers (29 CFR 1926.451(b)(10)). Install and use Diamond Deck only as described in our written instructions. Descriptions of testing status on the Site describe work in progress and are not a certification. See the product safety notice.
Intellectual Property
The Site, its text, images, video, drawings and the Diamond Deck name and logo belong to [COUNSEL: owner] or its licensors. Diamond Deck is covered by a pending U.S. patent application. You may view and print pages, and share the submittal pack inside your organization for evaluating the product. You may not copy, modify or reuse Site content for any other purpose without our written permission. Other product names on the Site are trademarks of their owners and their mention does not imply affiliation or endorsement.
Acceptable Use
Do not misuse the Site: no attempts to break in, overload or scrape it, no false quote requests, no unlawful content in messages.
Third-Party Links
Links to other sites, including diamondscaffold.com and government sites, are for convenience. We are not responsible for their content.
Disclaimer
The Site and its content are provided "as is". To the fullest extent the law allows, we disclaim all warranties about the Site, express or implied, including merchantability, fitness for a particular purpose and non-infringement. Product warranties, if any, are given only in the written terms of sale or rental.[COUNSEL: Louisiana uses redhibition (La. Civ. Code art. 2520 and following) rather than UCC implied warranties; confirm the waiver wording for Louisiana and for sales into other states.]
Limitation of Liability
To the fullest extent the law allows, we are not liable for indirect, incidental, special, consequential or punitive damages, or lost profits, arising from your use of the Site or reliance on its content, and our total liability for any claim about the Site is limited to one hundred dollars. Nothing in these terms limits liability that cannot be limited by law, including liability for intentional or gross fault or for physical injury.[COUNSEL: La. Civ. Code art. 2004 voids clauses excluding liability for intentional or gross fault or for physical injury; confirm the carve-out wording.]
Governing Law and Venue
These terms are governed by the laws of the State of Louisiana, without regard to its conflict of laws rules. Any dispute about the Site will be brought in the state or federal courts located in [COUNSEL: parish, for example Washington Parish or the Eastern District of Louisiana], and you consent to their jurisdiction.
Changes
We may update these terms by posting a new version here. Continued use after a change means you accept it.
